§ 295-2. Contents of contracts for consulting or design services.

  • (a)

    The purchase request for any consulting or design services which contemplates a report or recommendation about anticipated future construction shall provide that the contractor will agree not to respond to any invitation to bid, nor to bid, on any contract for construction which is the subject of such consultation or design services. All contracts awarded for design or consulting services shall contain a provision that the contractor is disqualified and agrees not to bid on any future contracts for construction that may be connected with the scope of the consulting or design services for which the contract is issued.

    (b)

    This section shall not apply to contracts for design-build services provided that the director of the department determines that a purchase request for a single contractor to provide design and construction services is in the best interests of the department.
